On March 26, 2024, the law for improved use of health data, the so-called Health Data Utilization Act (GDNG), came into force. The law defines different possibilities for using your hospital’s health data:

In §1 (1), the purpose of the law is defined as follows: This law serves to regulate the use of health data for public welfare-oriented research purposes and the data-based further development of the healthcare system as a learning system. The aim of using health data is to develop a secure, better, and quality-assured healthcare system based on a solid data foundation to ensure healthcare and nursing, to promote research and innovation, and to advance the digitized healthcare system.

Furthermore, §6 (1) regulates: Health facilities processing data may continue to process the data stored lawfully in accordance with Article 9 (2) (h) of the Regulation (EU) 2016/679 if necessary, insofar as this is required:

  1. For quality assurance and promotion of patient safety,
  2. For medical, rehabilitation, and nursing research or
  3. For statistical purposes, including health reporting.
